I was able to assist a 27 year old client obtain a court judgment of approximately $15,000 in a wrongful dismissal claim in June 2016. The court judgment of Buchanan v. Introduction Ltd. can be found here. This was an unusual case which involved my client’s employment contract being cancelled by the employer prior to my client’s first day of scheduled employment. The court confirmed that a wrongful dismissal can occur prior to the start of work – in particular, absent an express notice provision or probationary clause that applied prior to the first day of work, the defendant employer is obligated to provide reasonable notice of termination or pay in lieu of notice.
